Terms of Service — EXOfattura

Terms governing use of the EXOfattura cloud platform and mobile apps (iOS App Store and Google Play), provided by EXOBYTE S.r.l.s.

Versione italiana

1. Agreement

These Terms apply to EXOfattura (“Service”) provided by EXOBYTE S.r.l.s., VAT 04023700786, Via Prima Piana 16, 87075 Trebisacce (CS), Italy (“Exobyte”). Contact: info@exobyte.it / PEC info@pec.exobyte.it / https://exofattura.it/.

By creating an account, subscribing, or using the app you accept these Terms and the Privacy Policy.

2. Intended users

The Service is B2B (businesses and professionals), not for private consumers or users under 16. You confirm you act for a legitimate business and have authority to bind the customer entity.

3. Accounts

You are responsible for accurate data, credential confidentiality, and account activity (web or app). Supported authentication may include passwords and passkeys / device biometrics. Exobyte may suspend access for abuse, security risk, non-payment, or breach of these Terms.

4. Nature of the Service

EXOfattura is software for electronic invoicing and related business processes. It does not replace tax, legal or accounting advice. The customer remains solely responsible for SDI / tax authority compliance and for the accuracy of issued documents and uploaded data.

5. Mobile apps

6. Plans and payments

Features and limits depend on the subscribed plan. Prices appear in the product or commercial agreement. Online payments via Mollie are between the merchant and Mollie; Exobyte is not a bank or payment acquirer and does not hold end-customer funds.

7. Acceptable use

You must not use the Service unlawfully, attempt unauthorized access, upload malware or unlawful content, resell the Service without written consent, or circumvent plan limits / security controls.

8. Intellectual property

EXOfattura / Exobyte software, brands and documentation remain Exobyte’s (or licensors’) property. You receive a limited, non-exclusive, non-transferable license for the contract term.

9. Document retention

Statutory (“a norma”) retention of electronic invoices and other tax documents (Italian Ministerial Decree of 17 June 2014 and AgID Guidelines) is the customer’s obligation as taxpayer. Exobyte transmits documents to the Italian Exchange System (SDI) but does not provide legally compliant retention and accepts no responsibility for it. Customers may comply by joining the Italian Revenue Agency’s free retention service in the “Fatture e Corrispettivi” portal; joining is personal to the customer. That service covers invoices transmitted through SDI only. Exobyte keeps XML files and related data for the duration of the contract solely as an operational copy for use, consultation and download; it is not compliant retention. Customers can download their documents at any time and request a full export within 30 days after termination, after which Exobyte may delete the data unless the law requires otherwise. Exobyte is not liable for consequences of a customer not joining a retention service or for documents not retained elsewhere.

10. Availability and liability

We aim for reasonable availability without guaranteeing uninterrupted or error-free operation. To the extent permitted by law, Exobyte is not liable for indirect damages, lost profits, data loss, or outages caused by misuse, force majeure, third-party services (SDI, Peppol, Mollie, Apple, Google), or customer-provided data. Liability for willful misconduct / gross negligence and mandatory statutory rights remains.

11. Termination

You may stop using the Service per your plan/contract. Exobyte may suspend or terminate for material breach, insolvency or legal requirements. Account/data deletion follows the Privacy Policy.

12. App stores

Apple Inc. and Google LLC are not parties to these Terms and have no support obligations for the Service, except as required by their store terms. Store rules prevail for in-app purchases where applicable.

13. Changes, law and venue

We may update these Terms at https://app.exofattura.it/terms-en (Italian: /termini). Continued use after the update date constitutes acceptance unless otherwise required by law. These Terms are governed by Italian law. Venue: Court of Castrovillari (CS), except where a mandatory venue applies.
